Ethical Issues in Electronic DiscoveryÂ (1 Hour Ethics Credit)
A number of ethical issues can arise in the course of performing or managing electronic discovery, and this session will provide practical advice for mitigating against the commission of ethical violations in handling electronic discovery matters.Â The issues considered will include the duty to provide effective and competent representation; guarding against the unauthorized practice of law by document reviewers; the duty to supervise non-attorneys involved in the electronic discovery process; the duty to make reasonable inquiry before certifying to the completion of discovery; the duty of candor to the tribunal and opposing counsel;Â the duty to protect client confidences; the ethics of data mining; and some consideration of key cases involving electronic discovery (and ethical) failures and the sanctions imposed for committing them.
